If they are part of a group that considers itself a separate entity and wages actual war against the United States, yes. Either way, these other groups also wouldn't fall under Memorial Day anyways, which was the main point of this argument. If a communist group took up arms and attacked some place in the US and ended up battling US forces, would they suddenly qualify for Memorial Day? They didn't serve in the United States military but they lived in "America" and fought against the US military for what they thought was right, so why not?
