Why do you have trouble seeing this? Nobody has a problem with Obama doing his Constitutional duty of nominating a justice. What you and others do not seem to grasp is the FACT that it is the Senate's Constitutional duty to "consent and advise". Thus they are under NO Constitutional obligation to accept that nomination. In fact, they've already "advised" Obama what will happen.

The PEOPLE should have as much as possible to do with anything the government does. The last time the people "spoke" in an election we chose to kick out democrats and give the majority to Republicans in the Senate and the House to ward off a lawless President. With this President on his way out the door, it is perfectly within the Senates rights to hold off on a confirmation hearing.

If the people are dumb enough to vote in a Democrat to the Presidency then the Supreme court will more than likely swing to the liberal side. But, at least the people will have had somewhat of a say.

That's fine when Obama nominates someone then for the record they can do just that but, some to say Obama should not even nominate someone is just ridiculous. Which some have said by the way. As far as I'm concerned they even have hearings and not confirm the nominee.

Obama has every right to select someone, just as the republican controlled congress has the right NOT to confirm his choice. Republicans in control best not screw it up, and bend over once again and confirm his pick. Republicans will have to vote for conformation to confirm his pick. Plain and simple.
