and what would that be when they track scales prevail and you come up light you are done , when they find tires that does not meet the benchmark what more do you want

Some seem to want to get away from the facts here. The rules say a tire has to meet the benchmark of the manufacture, it says nothing about added chemicals, although that would not meet the benchmark. The 5 drivers agreed to this when entering. So hypothetically you could add a solvent that would evaporate, taking some part of the tires make up with it. The tire then, would not meet the benchmark and be illegal. If you where sold a special tire from the dealer, I doubt that neither party would be ignorant of the fact, that it would not meet the benchmark.It seems a driver should be more discerning about who he buys tires from. No matter how you put it, it was he driver that has to insure that the tire meets the bench mark. If he was sold a illegal tire unknowingly, they should be suing that guy and they shouldn't be buying tires from them again. Do you really want a tire deal from someone that is going to get you banned and labeled a cheater?

Bottom line is, these guys had tires that didn't meet the bench mark, unless they can prove the samples where tampered with or the benchmark was incorrect or the Lab didn't do a good job, How can they win? I don't think these guys thought this threw very well. Just because one of these Lawyers say something, it doesn't make it true. They have to have proof in a court of law or overwhelming doubt. It's a good bet, the defendants sent some of their sample to another lab for a back up expert witness. It they match, it's a slam dunk, if it don't they will discard it. The plaintiffs can send out a sample of that tire, but the chain of custody is slightly tainted and they better hope it matches the benchmark 100% or it may be worthless. If it matches, it does create doubt.

I think its funny some on here are such haters, that they wouldn't sue someone over a measly 100k. I guess only some of us with good sense would do so.....roll eyes!

If I was a betting man, I bet the fab 5's lawyer took the case on contingency! Generally, high profile lawyers only take those when its a slam dunk!
