Is it a safe assumption that you have met and spent enough time with the Ward family to pass such judgement? Please tell us all how you came to know these people well enough to label them as sorry ass people out for nothing but a chunk of Stewart's money.

The sworn testimony of Jessica Zemken-Friesen, who by the way was the first car behind Stewart at the point of impact with Kevin, paints a bit of a different picture. Please read the transcript of Mrs. Friesen's deposition, and try to read and absorb it with an open mind as opposed to preconceived notions. She actually saw what led up to, and the actual impact that killed Kevin Ward Jr.

I was desperately hoping and cheering for Stewart Friesen to win the NASCAR truck race at Eldora last July. The trophy presentation from Stewart to Friesen and his wife in victory lane would have been one of the most awkward, interesting and juicy things ever to be broadcast on live television! LOL!

Jilted lover? LOL! I will pose this question once again. Is this woman going to blatantly perjure herself and risk jail time and tens of thousands of dollars in fines just to get back at Tony Stewart? Could it be that she's telling the truth and some folks are desperately looking for a reason to debunk her sworn testimony? These shyster lawyers and judges take perjury quite seriously. Besides that she seemed to have got on with her life. She's since married, isn't she? She actually married a guy that doesn't go 275 and headed for 300. LOL!

Jilted lover? That smacks of being nothing more than a cop out from someone that appears to be in denial regarding what an eye witness saw.

He was walking down the track and away from his car because the car in front of Stewart had to turn to the left to avoid hitting the kid. He also grabbed the wing on Stewart's car because when he was kicked away from the car, the wing springs back up. Looked at the video many times.

                Stay in your car

I keep hearing stay in your car, NO SH!T.

Too bad it doesn’t happen. All the time they get out and throw stuff, tell you you’re number one, and so on. It just so happens this time it went horribly wrong. Ward come down, Stewart went up, and they collided.

If they have some kinda proof, so what if Wards family sues? The majority of your lawsuits are because of the death of someone. Is what it is.
Up in the air who my next “favorite” driver is. Really losing hope on Bloomer getting anywhere back to “normal”.

The initial reports I read from a couple of the other drivers on track, JZF was the only driver that saw KW.
If I remember correctly, one of the 2(?) drivers in front of TS stated he did not see KW, as did the driver behind JFZ.

I would agree that the precedent has been established but had the judge ruled the other way the case becomes far more winnable for Stewart. At least that's the understanding I have of the article.

Yes, but Tony Stewart, didn't have Ward agree to a worthless waiver. He was already vulnerable to a law suit. Now the ones that did have Ward sign it, are vulnerable. If i is tried, the question will be, what percentage of fault, each had. That would include the track, the sanctioning body, insurance co., Stewart and Ward. They all have a certain percentage, because they where there. It goes on from there.

They were BOTH at fault and TS is using excuses to cover up his mistake. Other drivers on the track saw KW on the track and out of his car. Only TS knows and he will take it 6' under
This isn't necessarily directed at you specifically, but you've voiced an opinion I've heard others parrot without explanation. Please explain How or Why TS would bother to kick up dirt/spray KW when there had been no contact between them and likely TS had no idea KW blamed him for his crash? KW was behind Tony when he hit the fence, so why would TS have any issue with KW at all? Everybody seems to want to jump to this anger conclusion, but what exactly happened that TS had any reason to be angry about? Is it believed TS just walks around PO'd all the time and slaps everyone he meets just because they are there? Is TS just from the drop of green looking for somebody to be mad at? Please explain for what reason TS had to be angry with KW?

If the video and any additional eye witness testimony are irrefutable like you say it is then Mrs. Friesen is a blatant liar and clearly perjured herself and will likely be charged and convicted as such. She said that Stewart entered turn #1 a lane or two higher than some of the other cars and veered to the right as he approached Kevin. If she's lying under oath that would be a HUGE price to pay for trying to get back at Stewart. If she knows she's lying she's playing a losing game of spite. I've never met this woman but I gotta' believe she isn't that dumb. If she perjured herself her vindictiveness could cost her dearly.

I never finished law school, hell I never even got accepted into a law school, so I am not intellectually in position to know if the point you're making is valid or not, it may well be for all I know. But what is clear is that this civil court proceeding has Stewart alone as the defendant because it's a wrongful death litigation. The articles I've read make no mention of additional defendants being added. Allowing additional defendants at this point in time would seem to be a stretch. Common sense would dictate that at this point in the litigation there would be no chance to add the sanction, track or insurance company as co-defendants. Plus, wrongful death and liability would seem to be two completely separate cases that couldn't be intermingled. If I'm in error I'll gladly and humbly stand corrected.

The fact of the matter is that KW was not hit by the sprint car. He grabbed the car pivoted from his hands to a horizontal position, then landed on a big spinning tire that threw him.
