    This case might have already gone away if not for the deposed testimony under oath of Jessica Zemken-Friesen. If you read the transcripts of the deposition under oath of Stewart as questioned by the Ward family attorney he gets pretty deeply into Stewart's past acts of aggression and periodic violence. Ward's lawyer also confirms through questioning that even though Stewart has been advised to do so several times he's never received counselling for anger and aggression management. Right or wrong, like it or not, all that could weigh heavily on the final verdict.

    I wonder if Stewart has ever reached out to the Ward family and tried to have a constructive conversation with them. It's probably a deal where the lawyers have forbid him to do so but it's a safe bet that it might have done some good. Too late now.

      They would have to narrow that down to a minimal of 2 to 3 hours prior to hi s death. You are no longer high after about two hours. The effects of weed peak in the first 10 minutes and diminish after that. By 2 hours later very little if any impairment remain.

      Again... It will be very hard to rule him under the influance of weed at the time he was in the car and out on the track.

        If he was still high on weed after 2 hours.... That was some dam abmormal weed. Just dont happen folks, not with weed anyway...

          Hey Phil, you seem to be rather learned as to the intoxicating nuances and staying power of marijuana. LOL!

                  Been smoking since i was a teen. Yes, I do have some idia here as to what I speak. Im sure many can confirm what I've said to be facts... Weed is in no way shape or form related to how alcohol or other dangerous drugs effect you. Weed calms you while under the incluance... It would appear in this case the kid was anything but calm.

                    I hear ya... It will be a shock if they somehow determine him high from the time he strpped in through the time he died. I feel he is at fault but I am just saying he would have literaly had to smoke it just prior to entering the race that night.

                        Just givin' ya' a hard time, Blackie.

                        My experience is much the same as yours. Aggression levels decrease exponentially and you become exceedingly less confrontational. If Kevin Ward Jr. was under the influence of THC at the time of his demise he goes against every known and researched psychological effect.

                          Yep, THC has been known to still be present in the human body at measurable levels for up to 32 days following the last usage. Possibly even longer in hair follicles.

                            There is zero evidence of ANY wrong doing on Stewart's part and the deceased was arguably somewhat impaired in his judgement and WAS the aggressor. Even watching the racing prior to his spin, he had nothing to be upset about. He screwed up, KW smoked weed prior to racing, KW caused his own wreck trying to make an undoable outside move, KW exited his car in a black firesuit against a black surface and KW charged a race car on foot. KW essentially used Stewart's car to commit an unintended, self inflicted man slaughter. As far as waiver's, my father in-law is an attorney and he told me 20 years ago they don't really do anything when its gets down to it in court. The only way the Ward's get any sort of payout is if the judge is on the tack or a close friend or relative. There was NO aggressive behavior from Stewart, period. And I'm pretty sure he had to do anger management back in the early 00's after a run in with a reporter, but I could be wrong on that point.

                              Dont mean he was high. It stays in you system weeks after smoking. You are only high for a very short time. To say he was under the influence for smoking hours before could not be true. I dont know of a way they can pin point the actual time of him smoking unless there is witnesses.

                                That break up did not go smoothly. That is for sure. Of the testimony that has been released her's is the only one that sides with the Ward's claims and beliefs.
