No it wouldn't be legal. I've seen it done several times, but in today's world, not a chance.

at least he tries different things.. I mean killing innovation is what got us to this point with cookie cutter cars in every form of motorsport.

Yep. A shock company that's lost a little buzz and a new car builder got a lot of press. That was the goal.

It is an interesting concept and it does have some merit. I don't think it really affords a competitive advantage as much as it puts the (expensive) shock in a more protective location by placing it horizontal up in the hoop and connecting the suspension components with a strut rod in the near vertical mount. Should you get in a wreck the cheaper strut rod takes the abuse and not the expensive shock.

You can change the shape of the load curve, but no, not really a lot of advantage to it. You can have some positive impact on unsprung weight too, if you mount them low and use pull rods instead of push rods.
