The way I see it, if he lost his temper in one spot, it is certainly possible it happened another time.... I don't know where the deal is in the court system or if its finished, have no clue.... just a subject....

I didn't capitalize the first letter of his name a couple of times and merely made mention of the fact that borderline psychopathic behavior of his past might well work against him in the court of public opinion and in civil court, as well. The actual civil case brought by the Ward family has not gone to court at this point. The only news concerning the civil case that has been made public is that the courts upheld an earlier ruling that Stewart's insurance company would in no way be obligated to cover any punitive monetary settlement that may result from the Ward family wrongful death civil suit.Last edited by CIRF; 09-06-2016, 09:26 PM.

It seems to me, a sharp lawyer accompanied with a recording of this incident could certainly ad the shadow of doubt... that's all I'm saying, nothing more and nothing less.... I have heard Tony's recollection of the incident (NASCAR) and it just doesn't wash.... but a judge and jury that knows nothing about racing, who knows..

Oh, I understand what you're saying and this is one of the rare instances that your logic isn't flawed! LOL!! But believe this, there are many, many folks out there that will not allow themselves to consider even the most plausible scenario's concerning their favorite celebrity figures. Many believe Stewart acting out irrationally in the past and now this should have no bearing at all on this case, but there is absolutely no doubt that it can, and with the right attorney, it will. One example is the case of the football player that knocked his girlfriend out cold on an elevator and drug her out while she was unconscious. Immediately there were women walking around wearing this players' jersey in support and refusing to believe their own eyes. They made excuses that the woman did something to warrant and justify being knocked cold by a professional football player. There is no rational explanation for defense and justification of such things but people will not waiver. Sports of all kinds can bring out some very unsavory traits in fandom. I'm reluctant to call them fans, at the very least they're misguided.
Another example is Joe Paterno. There are thousands of Penn State supporters that will not acknowledge that Joe Pa knew for a very long time what Sandusky was doing and never acted accordingly. The evidence is damming beyond reproach but they want that statue put back in front of the stadium in Happy Valley. It surely makes you shake your head and wonder.

It seems that maybe in this case NASCAR gave Stewart a pass. Stewart expressed no justification or even implied that it was a mistake or miscalculation on his part. He merely said with a degree of smartassmanship (is that a word? LOL!) that Scott wrecked. Maybe they (NASCAR) figure it's his last go round and Scott isn't in a position to get in the 10 race gimmick so they'll let it go and hope it goes away quickly and isn't repeated somewhere down the line before Stewart fades off into the proverbial sunset.
All that having been said, something seems very irrational and unnecessary about this latest dust up, even by Stewart standards.

I don't like when Kyle has his rants, but then, he hasn't had anything worth noting for a couple of years now, but even at that (and I say this knowing I could get flamed) he still hasn't killed anyone....

I respect his accomplishments behind the wheel and there is no doubt he is a great driver, will go down in history as a great all around driver who could race anything and win. A real "racer's racer" by any measure.
But person? Hardly. Probably one of the biggest jerks with issues to ever sit behind the wheel. Nothing more than a bully or thug with talent.
A friend of mine who used to do photos of professional athletes for over 25 years (NHL, Baseball Cards, Football games, etc) said that the environment that produces exceptional athletes over many years is not the kind of environment that makes them nice people.
Think about it, ever since you were a kid people look at you as "special" and "gifted" and make exceptions for every stupid thing you do because they admire your talent or want you to keep doing what you do exceptionally well so they can benefit from it. Winning apparently justifies everything in the elite athletes world.
As far as Tony Stewart's civil case, if the family puts up a video of Tony's Greatest Hits in racing as some kind of proof he is an angry, deliberately malicious person, then all Stewart's lawyers have to do is put up a video compilation of ALL the other drivers doing the same thing... Logano/Kenseth, Kenseth/Keselowski, Edwards/Keselowski, Keselowski/Edwards, Harvick, Gordon, both Bush brothers, etc. The list is endless of drivers deliberately wrecking each other for whatever reason and that would pretty much show the culture or racing is deliberate contact and retaliation.
It's kind of like trying to charge a hockey player with assault for a fight during a game when fighting is an accepted part of the game. In each sport, a certain level of confrontation and aggression is expected and what happens during the course of competition is not held to the same legal standard as if you did it outside of the sport.
If that was a video of Tony on the Santa Monica Freeway turning another car and wrecking them, you'd have something. But as it happened during a race, and it happens all the time in races, it amounts to nothing.
