So my wife's younger brother passed away & my wife was on his will to take care of his estate .... Got a lawyer & we were told it would be two weeks to get though probate .... Its just a small deal so it looks pretty simple but we need a attorney to put everything in motion ... My wife being power of attorney over his will was good till he died ....Now were locked out of his account to pay his bills ....Cant sell his house till the lawyers get off their rump & get my wife the ex/estate paper work ... So I was talking to a lady at the cemetery about my mothers estate planning ... Im doing this now to get ahead of things .... So as were chatting she tells me shes hears this all the time from customers ....Seems shes in the position to know much more than the regular person might .....So anyway she tell s me if my wife would have done a living trust for my brother ....Nothing would have had to go through probate court ....?? Is this true ?? She claims the attorney want everything to go to probate so we have to use them .... This estate lawyer chargers 5 % OR THE FIRST 100 K .... Less for the second 100 k .... Flat rate we were told ....So im looking at the paper work we got from the attorney and I see a living trust is around $ 1700 ..... So im wondering what the heck is going on .... A simple will ( like her brothers ) is going to cost us around $ 7500 .... Anyone have any dealing with something like this .....

tax laws and witch direction for my best results . Which I trust their advice more .

Sorry.... if I made this sound dramatic .... Its not about the money to me with her brothers estate .... The whole thing is very sad .... I feel like if I was better informed , I could have made a better decision ....Retired - Snowbird ... Living the Dream
