    I think this all comes down to Kevin getting out of his car and advancing toward a moving race car in a low light situation. I've never cared much about smoke, but this isn't even a discussion if Kevin stays in his car or walks towards the infield away from cars circling the track. I'm not a lawyer but I think I could make a pretty decent argument that Kevin may have had anger control issues to take the actions that he did.

    It's a sad situation all around. No one will ever know what either of them were thinking at that moment. But this is a good lesson for the future. Drivers need to check their emotions on the the racing surface and handle disagreements in the pit area after the race.

      My theory is that TS tryed to kick up dirt and spray KW ans miss judged not wanting to hit KW. This comes from TS past aggresiveness. They were BOTH at fault and TS is using excuses to cover up his mistake. Other drivers on the track saw KW on the track and out of his car. If KW had no drugs in his system then would it be a different story w same results?
      Only TS knows and he will take it 6' under

        Back to the post. It has been said many times, that pc of paper you sign coming into the pits doesn't mean diddly. As for his family. Some lawyer got them to sign on. He probably isn't charging the family a dime. But, he probably is going to walk with 70% if the courts award anything to the family. So after all the fillings from both sides it will probably take years before anyone sees any money. TS has attorneys on retainer I'm sure of that. What does a good lawyer lead too ? A Krooked politician .....

                This is true, however most will only smoke an amount to get that buzz they desire, for what ever reason. The weed now is the same as it was in the days of bell bottoms and peace signs. Just more potent. You regulate your intake and save on your stash... 😉"

                      😂😂😂 that funny stuff there. What was his toxicology level before and after death? If its so accurate they dont they have test to see if you been smoking while driving.                             Personally, I put the guilt at about 70-80% Kevin’s, and the rest on Tony because he did go up the track to scare Kevin. And I 100% believe he misjudged Kevin, and Kevin got too close, ending in a tragic accident. Do I think weed had anything to do with it? He!! no. Tony is a hot head and that is why I place some blame on him. He put Kevin outta the racing line, and Kevin lost it. And instead of just flicking him off, or just joining back up at the tail, he made a fatal mistake. Shame for Kevin, and on one hand Tony.

                            I’d settle out of court and be done with it personally. And I would believe her testimony, she has moved on.


                            CnBF, I think your percentages are pretty close to being correct. If I recall correctly the way the law looks at these situations is Stewart has a portion of guilt just for the fact that he chose to be there. What works heavily against Stewart is his extended history of borderline psychopathic behavior. Without that there wouldn't even be a discussion, let alone civil litigation.

                            I've never met Kevin Ward Sr. or Kevin Jr.'s mother and I suspect no one here commenting has either so to say it's merely a money grab is somewhat unfair, but hey, when did that stop the judgement's from coming forth? Judging by what the Ward's have said publicly they're convinced that Stewart, while having no intent to hurt Kevin, wanted to send a message and made a split second decision to buzz the kid as he went by. Kevin made a split second decision to somehow express his displeasure towards Stewart but probably didn't anticipate that Stewart was going to buzz him and the combination of actions on the part of both drivers led to one of the most tragic incidents in the history of racing.

                            All of us who attend races on a regular basis have seen pissed off drivers get out of their racecars to berate, gesture or try to get the other guy stopped so they can try to give him a "tune up". In a lot of cases this has been standard operating procedure and ended in some hurt feelings and at the most a black eye. Not this time.

                              the fact that this is still even being argued about is just crazy to me... DONT GET OUT OF YOUR CAR and go after someone on an active racetrack.. problem solved and this wouldn't be an issue...

                                I don't know all the science, but is it easier to tell with an autopsy. Not possible with a living person. When you are dead, they can take fluid from your eyeball, lots of other tests that are not done by the highway patrol on the side of I-75.

                                Believe what you will, but science is a wonderful thing.
