A couple new cars, maybe a lake house or two from Tony will soften the blow a little and honor their deceased son in the way they see fit.

1000's of drivers get out of their car after a wreck but only 1 died that year. Tony was speeding during the yellow and killed that kid.

JZ also was a friend of the deceased and her view was NOT directly behind TS, as she herself testified, that she had moved lower on the track after they came over the radio and said, "Stay Low, Go Low". The driver ahead of TS also testified that he nearly hit KW when he passed him and feared the next car in line(TS) would most likely hit KW, which he did. That same driver ahead thought KW was coming after him and NOT TS. In the video the rear of TS car goes left, not right as some have speculated or assumed. I don't think JZ is intentionally lying, but the horror of witnessing another human get run over is traumatic and add to that he was a friend too. So years go by before she is deposed, others offer their input as to what they think happened and its not hard to imagine her recollection being off or contaminated. In a criminal court of law, with expert analysis of the event/video and eye witness testimony he was cleared as NOT intentionally or UN-intentionally causing KW harm. I've seen the professional breakdown of the video and no one comes to the conclusion that he revved his engine o attempted to dust KW, that did NOT happen, it didn't.
If Stewart's counsel can absolve and refute Mrs. Friesen's testimony they will. And if they do that to the degree which can be perceived in such a way as to show premeditated untruthful prejudice under oath, it's perjury. In fact, you've conveniently and totally dismissed her part of the story as untruthful for a variety of emotionally charged reasons. If all the things you say hold water then she obviously perjured herself. You merely chalk it up to a bad parting of the ways and feelings for a friend who is dead.

We can debate the evidence here all day long but when it's all said and done the jury or trial judge will have the last word. It's easy to see the preconceived prejudices here according to whether your in Stewart's corner or lean towards supporting the Ward family. Personally, the outcome of this deal has no particular effect on the quality of any of our lives, nor can any of us get into the minds of Kevin's family to fully understand why they're doing what they're doing. Many dismiss them as money grubbing fools looking to cash in on Stewart's monetary success. I wonder if those judgement's are being made by someone who has lost a child. It might make a difference as to the outlook but if it hasn't happened to you it's doubtful and objective viewpoint is possible. If Mrs. Friesen's testimony is brought into question for reasons of vindictiveness and revenge then it's altogether feasible to refute that with Stewart's past psychopathic outbursts and sometimes violent outburst's. One thing is for sure, all that can't be refuted by anyone.

                    Jackpot justice......

And well said cirf, can't disagree with anything you said , my opinion is pretty harsh only because I haven't read or seen anywhere where the family has accepted Kevin's actions as anyway at all responsible for the outcome.......maybe I missed it?

Like any real bad accident, there were multiple decisions and actions that played a part in the final outcome......

Ya' know BBQ, come to think of it, I haven't seen anything from Mr. & Mrs. Ward which admits to any responsibility on Kevin's part, either.

Don't you think maybe the shyster lawyers have strongly advised the Ward's from doing so? Anything they say in that regard could probably enter into the court proceeding to the detriment of their case. They really can't be that be that stupid or blind as to not acknowledge Kevin's actions led to what killed him.

I lost $160k in a lawsuit because of a judges beliefs and not the law!

Afterwards, I was telling my disgust to my lawyer, and he quipped a statement I have never forgotten......."you went to a court of law, not a court of justice"!

Might not have been the judges beliefs. There prolly was some $ behind closed doors that changed hands.

No shame need be passed your way, BBQ. I'm pretty sure we all know what you said earlier is an opinion you've formed from the information available to the public. You may well be correct in your opinion that they are money grubbing opportunists. I reckon it's one of those deals where the only way to know for sure is to look deeply into their souls and unfortunately none of us here has that ability.

Your right, it obviously does suck for everyone involved including racing itself. All we can hope for is that justice prevails in some manner. If the Ward family truly deserves to prevail in this case then I hope they do. If Stewart truly deserves to prevail then I hope he does, as well. But, from 1000 miles away it's really hard to know one way or the other.

You are right. Only 1 car accelerated and turned towards the kid. In over half a century of being around racing I've seen drivers get out of the car no matter what because when they ran alcohol they could be on fire and not even know it. It was drilled into their head to get out asap. I've seen drivers flap the bird, throw clods of mud, throw the steering wheel, and I've even witnessed Stewart himself fling his helmet at another driver. Hell, I even saw a guy drop his pants ant shoot the moon at a scorned fellow competitor ! But this is the first and only time I've ever heard of a driver going berky enough to gas it and aim at a driver on the track on purpose. Look at all of the Indy, sports car, and early dirt races where the flag man stood on the track to run the race and never got mowed down !
