Sad to see that there is going to be a settlement. That means that the Ward family is going to get something when they shouldn't be entitled to a red cent.

"They were both at fault, plain and simple."

Can't agree with you on that one. I can't see anything Stewart did wrong that night and his so called temper tantrums in the past having no bearing on the night of the accident. The throwing dirt on the kid scenario and the sounds of wheel spin are both a bunch of hooey because the sounds recorded were from the front stretch grandstands and all one could see in the video was Stewart turning left to avoid the idiot on the track and the wing being pulled down by the weight of the kid. The moment he was thrown, the wing springs back up.

I might be wrong but I'd bet a 10 spot that the monetary settlement is sealed and a nondisclosure clause of all concerned is part of the deal. As I said, I could be wrong but it's still a safe bet. A charitable donation would be fitting. The Ward family gets the justice they believe they deserve and Stewart doesn't have to be cross examined by a hostile attorney for the plaintiff. That's a scenario that even Stewart would likely want to avoid. He'd have to set quietly and answer the questions and he couldn't lay a finger on the lawyer doing the asking.

Don't blame the Ward family for the stupidity of the civil court system. If there was no possible chance of Stewart being found 51% or more responsible for the death of Kevin Ward Jr. there wouldn't have even been a civil case to talk about. Never have and never will agree with marginal civil litigation but we've allowed it to happen so it's just a bit hard to fault someone for taking advantage of it. Blame the civil judicial system in the State of New York.

It's clear that Stewart's lawyer's don't agree with you or this would have gone to trial and Stewart would have prevailed. That is if it was cut and dried that he did nothing wrong. When Stewart and his legal counsel decided to settle he assumed at least partial culpability for Kevin's death. Doesn't matter if you believe it, or I believe it or if Stewart believes it.

This will be my last post on this thread because I think the entire situation should be done being talked about.

Like I mentioned in my post above, I'm not sure how anyone can blame the entire situation on one side or another. Ward did what a lot of drivers have done in the past and got out of the car to voice his displeasure with Tony. He should have stayed in the car. That's on him. Tony gassed his car up when he saw Ward was mad at him to say "hey screw off." That has been done in racing, many times as well. Neither wanted this incident to go as far as it did, and often times emotions get the best of people and bad things happen. Things went wrong that night and nobody can take it back, I fail to see how you can blame one side more than the other...

Gary, if I have Stewart's monetary resources at my disposal and truly believed that I did absolutely nothing wrong I'd prove it in court for no other purpose but to clear my name of the slightest hint of wrongdoing. We've always been told that Stewart is a stand up, tell it like it is kind of guy who stands solidly on principal. I don't think he'd allow any degree of responsibility to be attached to his name if he was positive he was not the least at fault. Regardless of who gets the money from the out of court settlement there will always be at least a partial admission of guilt. It's a matter of public record no matter what any of us think.

Don’t know enough to have an opinion. Seen way too many situations at tracks where someone’s emotions got over the top and the end result could have been bad. This time it evolved into one of the worst possible outcomes, good lesson for all of us. May both parties find some peace.

No winners in this deal...I can see both sides. If I were TS and had the money he does I would settle as well. Even if he believes he was truly innocent, he doesn't have to sit through a trial and deal with all the stress and pressure. Just settle and finally be done with it.

Some times its better just to end it even when you think you are right..

Very sad deal all the way around. Nobody intended real harm to anyone but the dammage was done. Hopefully good will posably come from this but the ones closely involved will always be at a loss for it.

As Pennsboro said, there is culpability on both sides of the equation and those that believe one side or the other is without blame have been proven wrong, at least in the opinion of legal counsel for Stewart.

In my mind it was the sworn deposition of Mrs. Stewart Friesen and Stewart's sketchy history of raging outbursts which had the Stewart lawyers the most nervous. She swore to some pretty damaging stuff for Stewart and his past speaks for itself.

I really wish Stewart Friesen would have won the truck race at Eldora last July. That would have made for an incredibly uncomfortable Kodak moment!

Well said by both of you, and I think you guys are absolutely right. The part of this whole thing that irritates me is the blind support of Tony Stewart fans and their trashing of Ward and his family. As you both said, there’s blame to be given to both sides. The immaturity of those that have made some negative comments about Ward’s family because they can’t accept the possibility that Tony could ever do something wrong is really a shame.
